APPLICATION OF THESE
Your contract with North View Adventure Ltd is subject to these booking conditions. A contract will exist between us once you have paid your deposit or full payment in case of a “late booking” and we have issued you with our booking confirmation. If any part of our contract with you is found to be invalid or unenforceable, then the remainder of it will not be affected and will remain valid and enforceable.
When you make a booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions and agree on behalf of everyone travelling in your party to be bound by them. All bookings must be made by a person aged eighteen years or over. Where your booking is for more than one person, the first-named person in your party aged eighteen years or over will be treated by us as the ‘lead name’ for your booking. The lead name will be responsible for making all payments due to us in accordance with our contract.
Completion and submission by you of our Booking Form will be treated by us as confirmation that you have read, understood and accepted these booking conditions.
LAW AND JURISDICTION
This contract is governed by English Law and the exclusive jurisdiction of the English courts.
DATA PROTECTION
The protection of your personal information or data is extremely important to us. In order to respond to an enquiry, process and fulfil your booking or send you a brochure or other promotional material, we need to collect personal data from you. We will only process your personal data in accordance with our Privacy Policy for or in connection with the purpose for which you have provided it (for example, arranging your holiday) or as you have consented to our using it (for example, to send you marketing material) or as permitted by data protection laws. Our Privacy Policy can be found on our website. Please read our Privacy Policy for full details. You and your personal data will be protected by the UK’s General Data Protection Regulation (which is otherwise known as UK GDPR) and the Data Protection Act 2018. We refer to this legislation as data protection laws.
North View Adventure Ltd is a data controller of your personal data. We take appropriate technical and organisational measures to protect against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data, which is appropriate to the harm that might result. Your personal data will be retained by us for the period referred to in our Privacy Policy.
You may ask us what personal data of yours is being held or processed, for what purpose and to whom it may be or has been disclosed. You may also withdraw your consent to receiving marketing material or other communications from us at any time by unsubscribing to our e-mails or otherwise contacting us. Please also let us know if you believe the personal data we are holding is inaccurate, out of date or incomplete. THE PRICE AND PAYMENT
You will be notified at the time of booking of the price of your holiday. What this price includes will be confirmed to you by us at the time of booking and set out in our booking confirmation. A 25% non-refundable deposit is required at the time of booking. The balance is due 6 months before your departure date. If we do not receive the balance on time, we will treat the booking as cancelled by you and you will be liable to pay our cancellation charges (see paragraph 9c).
We accept bank transfers for all payments. There are no fees for a bank transfer within the UK. For international payments, there is an additional 1% fee. All documents issued by us will be sent by email. If you would like a paper copy, there will be an administration charge payable by you of £25 per booking.
Your holiday price does not include:
• Flights
• Holiday insurance
• Personal expenditure
• Excursions not included in our package
• Hotel extras
INSURANCE
You must be fully insured for your holiday and must make sure that all of the activities which you will be carrying out are covered by such insurance. This insurance must include adequate cancellation insurance to the value of your holiday, emergency evacuation and repatriation costs in respect of all of your activities. Please note that the travel insurance provided by some credit card providers often only offers the minimum coverage and, whoever your insurer, you should always check for any exclusion of activities that you might be undertaking.
EXCURSIONS
Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.
INFORMATION
Whilst we make every effort to ensure that the information on our website and publications is as accurate as possible (details are often published many months before your holiday takes place), we reserve the right to make changes. You will be informed of any changes before booking or as soon as they occur (see paragraph 5b). We are only responsible for information contained within our own publications and website. We are not responsible for third party information (tourist boards and hotels for example) contained in any other brochures or websites.
CHANGES OR CANCELLATION BY YOU
a) Changes by you
i) Transfers
You may transfer your booking to any other person satisfying all the requirements relating to your holiday notified to us by you in writing at least seven (7) days prior to your departure date. Both you and the new traveller are responsible for paying all costs we incur in making the transfer. We will charge an administration fee as set out in (iii) below for arranging the transfer and other costs or additional fees may also arise, which you will have to agree to pay before the transfer can be made.
ii) Other changes
If you wish to make any other changes to your booking at any time after our booking confirmation has been issued, we will try but cannot promise to meet your request. We require your authority in writing before we can make any change. If a change is requested in relation to a group booking, we require the authority in writing of the lead name before we can make the change.
iii) Administration fee
In each of the above circumstances, an administration charge will be payable of £30 per person where your request is received by us 60 days or more prior to your date of departure and £50 per person where the request is received less than 60 days prior to your date of departure. This charge is non-refundable.
We cannot accept an amendment that results in a loss of income for North View Adventure Ltd without passing this cost on to the customer. We also reserve the right to treat any amendment less than the applicable 10 weeks prior to departure as a cancellation and apply the cancellation charges set out below.
b) Cancellation by you
If you wish to cancel your booking after you have received a booking confirmation from us or any part of it relating to any person (in the case of a group booking), we will require your authority in writing, or in the case of a group booking, the authority in writing of the lead name to do so.
Our cancellation charges will apply as set out (see paragraph C below). These are calculated with reference to the date on which we receive your authority in writing. We will not refund to you any deposits, administration charges, insurance premiums or any other fees or charges made by us and paid by you relating to your holiday in the event of cancellation by you.
We incur costs from the time you make your booking and you agree that if you cancel your booking, you will compensate us for our losses and expenses, as per the table below. Our cancellation charges increase the nearer the cancellation is made to your departure date as we may not be able to resell your holiday without making significant price reductions, or at all.
We strongly recommend that you take out insurance cover for cancellation adequate to cover the value of your holiday. If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
c) Cancellation charges
Number of days left before your due date of departure when your authority in writing is received by us. Cancellation charge (expressed as a percentage of the total holiday price):
• 8 weeks or more: forfeit deposit
• Between 6 and 8 weeks: 50% of full holiday cost
• Less than 6 weeks: 100% of full holiday cost
IF YOU HAVE TO CHANGE OR CANCEL YOUR HOLIDAY
a) Cancellation by Us
We reserve the right to cancel your booking. We will not cancel less than 8 weeks before your departure date, except for:
• Unavoidable and extraordinary circumstances. This means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. These include, but are not limited to, war, threat of war, riot, civil disturbance or strife, terrorist activity (actual or threatened), industrial disputes, technical or maintenance problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions, levels of water in rivers, acts of God, closure of airports, changes of schedules or operational decisions of transport providers.
• Failure by you to pay the final balance.
• The minimum number required for the package to go ahead hasn’t been reached. The minimum number required will be provided to you with the holiday description, along with the time limit for us to tell you if the package has to be cancelled.
If your holiday is cancelled, you can either have a refund of all monies paid or accept an alternative holiday of comparable standard from us if we offer one (we will refund any price difference if the alternative is of a lower value).
Compensation will not be payable in any cases where an amendment, change or cancellation is due to “force majeure”, being unusual or unforeseeable events or circumstances beyond our control, the consequences of which neither we nor our suppliers could avoid.
Compensation is not payable if a holiday does not take place because a required minimum number of passengers to enable the holiday to take place has not been reached. The minimum number of passengers is clearly stated on the prospectus/website for each holiday. We will refund any monies paid to us promptly. However, we will not pay for any additional expenses you may have incurred – e.g. travel tickets, etc.
b) Changes to the price
All prices advertised are per person based on a share use of a bedroom (twin/double share basis). The prices are in pounds sterling unless otherwise shown and are subject to change, up or down, until the booking is concluded. After that, we will only increase the price in limited circumstances to reflect increases in fees chargeable for services, Government action or exchange rate variation.
If the surcharge would increase the cost of your holiday by 10% or more, you are entitled to cancel your holiday and receive a full refund. We will absorb, and you will not be charged, for any increase equivalent to up to 2% of the original price of your holiday. If the surcharge is more than 2% and less than 10%, the cost will be yours to pay. If you decide to cancel your holiday, the cancellation fee will apply (see paragraph 9c)
c) Changes other than the price
It is occasionally necessary for us to make changes to advertised products and services and we reserve the right to make such changes. In exceptional circumstances, we may have to modify your holiday after booking. If the change is minor, we will do our best to notify you in advance but are not obliged to do so and no compensation is payable. If the change is material (e.g. change of itinerary or a lower standard of accommodation), we will notify you as soon as practically possible and offer you the choice of accepting the alternative arrangements, postponing or cancelling your holiday.
OUR RESPONSIBILITY
We take care to ensure that all involved in the preparation and supply of your holiday maintain the highest standards. Please remember that the appropriate standards will be those prevalent in your destination which may not be the same as developed international standards.
If you have any special requirements (dietary or otherwise) you must inform us of these at the time of booking so that we can pass these onto our suppliers. We cannot guarantee that your requirements will be met, however, and we are not liable to you in the event that your wishes are not met.
YOUR RESPONSIBILITY
a) It is your responsibility to ensure that you and everyone travelling with you have valid passports, appropriate visas (if applicable) and vaccinations. Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Some countries require your passport to have two blank pages for a visa stamp. As a result, if you are travelling in more than one country that requires this you will need to have more blank pages If you have any doubts about the number of pages required, we advise erring on the side of caution, even if this means applying for a new passport.
b) You are responsible for ensuring that any existing medical conditions or disabilities which may require assistance are declared to us before you book your holiday or, if newly diagnosed, before your due date of departure so that we can pass these details on to our suppliers in good time. We are not in any circumstances liable if any service provider refuses you or any member of your party as a passenger as a result of any medical condition or disability. We are not liable for any costs, delays or illness resulting from your failure to meet any requirements.
c) You are responsible for your behaviour and that of your party. We and our suppliers reserve the right to refuse your booking or the right to travel and to remove you and/or any member of your party from any transport, accommodation or any part of your holiday if you or any member of your party is drunk or under the influence of drink or drugs; if you are or we reasonably believe that you are in unlawful possession of drugs; or are behaving violently, disruptively, dangerously or irresponsibly or in any manner whatsoever which presents a risk to you or others or is causing a nuisance or annoyance to others. No refund will be given, or compensation paid, and no costs or expenses for which you become liable or which are incurred by you will be made by us or be recoverable by you from us in such circumstances. You may also become the subject of police inquiry or security measures or investigation and liable in the event that any offence is committed to criminal prosecution and penalties whether in the UK or in any other country having jurisdiction in respect of the alleged activity. You must fully cooperate with and follow any safety procedures and instructions given by any service provider which is running the activities which you do while on holiday. It is possible that such provider will require you to sign a waiver form in respect of the activity being carried out.
COMPLAINTS
If you have any complaint or problem whilst on holiday, you must inform the relevant supplier whose service is involved (e.g. hotelier) and our local representative as soon as possible to give us the maximum opportunity to rectify it. Any unresolved complaints must be notified to us in writing within 28 days of your return giving your booking reference and all other relevant information. Please keep your letter concise and to the point. If you fail to follow the requirement to report your complaint whilst on holiday, we will have been deprived of the opportunity to investigate and rectify it whilst you were on holiday and this may affect your rights under this booking.
TRAVEL INSURANCE
Your holiday package with us does NOT include travel insurance. You must be fully insured for your holiday and must make sure that all of the activities which you will be carrying out are covered by such insurance. This insurance must include adequate cancellation insurance to the value of your holiday, emergency evacuation and repatriation costs in respect of all of your activities. Please note that the travel insurance provided by some credit card providers often only offers the minimum coverage and, whoever your insurer, you should always check for any exclusion of activities that you might be undertaking.

For your guidance, we suggest you visit the website of the Foreign Office on: https://www.gov.uk/foreign-travel-advice/tunisia/entry-requirements to check advice about your destination. The website is regularly updated and provides you with country-specific information, including advice on terrorism and general matters on health, visa requirements, vaccinations and safety.
ADDITIONAL INFORMATION
In addition to these general booking conditions, specific relevant destination information may be contained within the booking information documents you receive on confirmation of your booking (e.g. kit list, itinerary, etc.)
MARKETING MATERIAL FOR OUR WEBSITE AND SOCIAL MEDIA
During our treks/activities we may take photographs and videos. These photographs/videos may be used for publicity and marketing purposes in the future. They will not be shared with a third party. It is your responsibility to tell us if you don’t want to be on the photographs.

Trek in Tunisia
a. Pre-departure online meeting
On confirmation of your booking, you will receive all necessary information. North View Adventure Ltd will organise a virtual meeting prior to the departure to:
• Introduce ourselves
• Going through the paperwork
• Answer any questions you might have
• Confirm your arrival times at destination and meeting arrangements
b. Meet and greet on arrival
• Our local representative will be at the airport and will have a North View Adventure sign.
• If you cannot be located, our representative will wait for a maximum of three hour
• Should your flight be delayed, it is your responsibility to contact North View Adventure representative immediately.
• If the delay is more than 2 hours, it is your responsibility to find arrangements to join the group where it is at your costs
c. Currency
• It is illegal to take Tunisian dinars outside the country. This is why you won’t be able to get Dinars in the UK. However, you will be able to exchange euros and pounds sterling at the airport on arrival and/or in banks, cash points in towns (bank fees might apply).
• Credit cards are widely used in restaurants and shops. However, we strongly suggest to bring pounds sterling in cash.
d. Code of Conduct
• It is essential to respect the laws in force in Tunisia and the rules of decorum, customs.
• We invite you to respect the people you meet, particularly the people who make up the Berber accompanying team and the hosts who welcome us in the places where we stay.
• We strongly advise you to dress in a way that is respectful towards the cultural and religious traditions of this country. We are very keen to prohibit the consumption of alcohol and illegal substances during the trips we organise.
• We also ask you to be discreet and to respect the prayer times, especially during the Ramadan period.
• We ask you to not distribute money, pens, sweets or any other gift to the children. Your generosity would eventually lead to begging.
• We count on you to responsibly use your camera: NEVER photograph a person without their consent, do not insist or try to find out why, avoid taking pictures without the guide’s approval. If you promise to send pictures, do not forget that this is a commitment that must be kept.
• North View Adventure displays an ethic of “discovery travel” that invites respect for the environment, sharing with the local populations and open mindedness.

EXCURSIONS/ACTIVITIES
The holiday booked with us is a walking holiday (trek) and does NOT include camel rides. In the unlikely event that you have a minor foot/leg injury, we might offer you to ride a camel for a while until yuo are able to walk. The availability of protective headgear can varie from destination to destination. Therefore we cannot guarantee headwear will be provided or will be to the same standards to those available in the UK. We suggest to anyone participating in this activity to bring their own headgear and make sure their travel insurance covers camel rides.
Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

We incur costs from the time you make your booking and you agree that if you cancel your booking, you will compensate us for our losses and expenses, as per the table below. Our cancellation charges increase the nearer the cancellation is made to your departure date as we may not be able to resell your holiday without making significant price reductions, or at all.
We strongly recommend that you take out insurance cover for cancellation adequate to cover the value of your holiday. If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.

Compensation is not payable if a holiday does not take place because a required minimum number of passengers to enable the holiday to take place has not been reached. The minimum number of passengers is clearly stated on the prospectus/website for each holiday. We will refund any monies paid to us promptly. However, we will not pay for any additional expenses you may have incurred – e.g. travel tickets, etc.
b) Changes to the price
All prices advertised are per person based on a share use of a bedroom (twin/double share basis). The prices are in pounds sterling unless otherwise shown and are subject to change, up or down, until the booking is concluded. After that, we will only increase the price in limited circumstances to reflect increases in fees chargeable for services, Government action or exchange rate variation.
If the surcharge would increase the cost of your holiday by 10% or more, you are entitled to cancel your holiday and receive a full refund. We will absorb, and you will not be charged, for any increase equivalent to up to 2% of the original price of your holiday. If the surcharge is more than 2% and less than 10%, the cost will be yours to pay. If you decide to cancel your holiday, the cancellation fee will apply (see paragraph 9c)
c) Changes other than the price
It is occasionally necessary for us to make changes to advertised products and services and we reserve the right to make such changes. In exceptional circumstances, we may have to modify your holiday after booking. If the change is minor, we will do our best to notify you in advance but are not obliged to do so and no compensation is payable. If the change is material (e.g. change of itinerary or a lower standard of accommodation), we will notify you as soon as practically possible and offer you the choice of accepting the alternative arrangements, postponing or cancelling your holiday.
OUR RESPONSIBILITY
We take care to ensure that all involved in the preparation and supply of your holiday maintain the highest standards. Please remember that the appropriate standards will be those prevalent in your destination which may not be the same as developed international standards.
If you have any special requirements (dietary or otherwise) you must inform us of these at the time of booking so that we can pass these onto our suppliers. We cannot guarantee that your requirements will be met, however, and we are not liable to you in the event that your wishes are not met.
YOUR RESPONSIBILITY
a) It is your responsibility to ensure that you and everyone travelling with you have valid passports, appropriate visas (if applicable) and vaccinations. Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Some countries require your passport to have two blank pages for a visa stamp. As a result, if you are travelling in more than one country that requires this you will need to have more blank pages If you have any doubts about the number of pages required, we advise erring on the side of caution, even if this means applying for a new passport.
b) You are responsible for ensuring that any existing medical conditions or disabilities which may require assistance are declared to us before you book your holiday or, if newly diagnosed, before your due date of departure so that we can pass these details on to our suppliers in good time. We are not in any circumstances liable if any service provider refuses you or any member of your party as a passenger as a result of any medical condition or disability. We are not liable for any costs, delays or illness resulting from your failure to meet any requirements.
c) You are responsible for your behaviour and that of your party. We and our suppliers reserve the right to refuse your booking or the right to travel and to remove you and/or any member of your party from any transport, accommodation or any part of your holiday if you or any member of your party is drunk or under the influence of drink or drugs; if you are or we reasonably believe that you are in unlawful possession of drugs; or are behaving violently, disruptively, dangerously or irresponsibly or in any manner whatsoever which presents a risk to you or others or is causing a nuisance or annoyance to others. No refund will be given, or compensation paid, and no costs or expenses for which you become liable or which are incurred by you will be made by us or be recoverable by you from us in such circumstances. You may also become the subject of police inquiry or security measures or investigation and liable in the event that any offence is committed to criminal prosecution and penalties whether in the UK or in any other country having jurisdiction in respect of the alleged activity. You must fully cooperate with and follow any safety procedures and instructions given by any service provider which is running the activities which you do while on holiday. It is possible that such provider will require you to sign a waiver form in respect of the activity being carried out.
COMPLAINTS
If you have any complaint or problem whilst on holiday, you must inform the relevant supplier whose service is involved (e.g. hotelier) and our local representative as soon as possible to give us the maximum opportunity to rectify it. Any unresolved complaints must be notified to us in writing within 28 days of your return giving your booking reference and all other relevant information. Please keep your letter concise and to the point. If you fail to follow the requirement to report your complaint whilst on holiday, we will have been deprived of the opportunity to investigate and rectify it whilst you were on holiday and this may affect your rights under this booking.
TRAVEL INSURANCE
Your holiday package with us does NOT include travel insurance. You must be fully insured for your holiday and must make sure that all of the activities which you will be carrying out are covered by such insurance. This insurance must include adequate cancellation insurance to the value of your holiday, emergency evacuation and repatriation costs in respect of all of your activities. Please note that the travel insurance provided by some credit card providers often only offers the minimum coverage and, whoever your insurer, you should always check for any exclusion of activities that you might be undertaking.

The website is regularly updated and provides you with country-specific information, including advice on terrorism and general matters on health, visa requirements, vaccinations and safety.
ADDITIONAL INFORMATION
In addition to these general booking conditions, specific relevant destination information may be contained within the booking information documents you receive on confirmation of your booking (e.g. kit list, itinerary, etc.)
MARKETING MATERIAL FOR OUR WEBSITE AND SOCIAL MEDIA
During our treks/activities we may take photographs and videos. These photographs/videos may be used for publicity and marketing purposes in the future. They will not be shared with a third party. It is your responsibility to tell us if you don’t want to be on the photographs.
